EU Finalizes Dechlorane Plus Restriction Under POPs Regulation
Dechlorane Plus restriction enters into force October 15
The European Commission has officially published its restriction on Dechlorane Plus, a chlorinated flame retardant, under the Persistent Organic Pollutants (EU POPs) Regulation. This follows its listing in Annex A (elimination) of the Stockholm Convention in May 2023, alongside UV-328.
The publication of Commission Delegated Regulation (EU) 2025/1930 in the Official Journal on September 25, 2025 marks the final step in the EU’s implementation of the global decision.
The regulation will enter into force on October 15, 2025, prohibiting the manufacture, placing on the market, and use of Dechlorane Plus in the EU, with exemptions for aerospace and some automotive uses.
Unintentional Trace Contaminant (UTC) Limits
The regulation establishes a phased approach to Unintentional Trace Contaminant (UTC) thresholds:
- ≤1,000 mg/kg upon entry into force
- ≤1 mg/kg after April 15, 2028
Exemptions run until 2030, while spare part allowances also extend to 2043. The Commission will review and decide on the possible extension of specific exemptions no later than April 1, 2028.
Dechlorane Plus Exemptions
Time-Limited Exemptions (Valid Until February 26, 2030)
The placing on the market and use of articles containing Dechlorane Plus are permitted for:
- Aerospace, space, and defense applications
- Medical imaging applications
- Radiotherapy devices and installations
Spare Parts Exemptions (Extended Use up to 2043)
Spare parts may continue to contain Dechlorane Plus until the end of their service life or until December 31, 2043, whichever comes first. This applies to:
- Land-based motor vehicles
- Stationary industrial machines for agriculture, forestry, and construction
- Marine, garden, forestry, and outdoor power equipment
- Aerospace, space, and defense applications
- Instruments for analysis, measurement, control, monitoring, testing, production, and inspection
- Medical devices and accessories under Regulations (EU) 2017/745 and/or 2017/746
Articles Already in Use
Articles placed on the market under valid exemptions and already in use before the expiry of those exemptions may continue to be used.
